Planning and Development Regulations (2001-2018) – Change of Use From Business to Residential


Chamber Members, local property and business owners might not be aware that as of 8th February 2018 there were enacted changes to the Planning and Development Regulations (2001-2018) so as to allow for ‘exemptions’ to the change of use to residential from certain business classes namely Classes 1, 2, 3 & 6 (as includes shops, financial services, professional services, offices and guest houses and hostels).

The allowance is to provide much needed housing supply at a time of need and where premises have been vacant for a two year period other conditions on the exemptions also need to be reviewed. This has important implications for Mullingar, the town and the available space for business uses going forward. 

In effect, you are enabled to convert your vacant (2 years previous) office/business/shop premises to residential without the requirement for planning permission so long as you notify the planning authority of your intention and to confirm ‘exemption’ 2 weeks in advance of same.
